"In response to media reports in Iowa published during the past week, Factor Health Management states:
In connection with litigation in which Wellmark, Inc. is accused of being the leader of a collective of BCBS plans who have cooperated with each other in a widespread effort to deny the payment of valid claims of their members, it was represented by attorneys for Wellmark, Inc. that Factor Health Management is "being investigated by the Food and Drug Administration, the U.S. Attorney's Office and the Blue Cross Blue Shield Association." It was also reported that Wellmark asserts that Factor Health Management is under investigation by the DEA.
Factor Health Management believes that those statements are malicious, false and defamatory and has given notice that it intends to hold liable those responsible for the statements.
Factor Health Management states unequivocally that it is unaware of any inquiry or investigation into any aspect of its business (or any of its employees) by any of the foregoing federal agencies. Attorneys for Factor Health Management have offered full and complete cooperation to those federal authorities, but no requests have been made to us. Our attorneys believe that there is no work being done by those agencies that concerns Factor Health Management or its employees.
The only "investigations" of which Factor Health Management is aware are those purportedly being conducted by various Blue Cross plans. Factor Health Management believes firmly that those "investigations" are shams designed solely to delay payments to Factor Health Management that the Blue Cross must make. The statements made by Wellmark’s attorney are nothing more than litigation posture.
Factor Health Management, and its directors, officers and employees are in full and complete compliance with all federal and state law, rules and regulations."
